Our By-Laws are the legal document that outline a set of standards and regulations for living in our community. They were amended and restated on June 15th 2011 and recorded in the Lee County Public Records as INSTR # 2011000138804  06/16/2011 at 10:52 AM.  The By-Laws were voted on by our community and everyone living in our community now or in the future must agree to abide by the By-Laws. When you purchase a home in our community, it is required that your real estate agent or title company give you a copy of the By-Laws.  However, ultimately it is your responsibility to know the By-Laws. Not receiving a copy or not knowing the By-Laws is not an excuse for not complying with them. They are a matter of public record and easily obtained. Failure to comply with the current By-Laws can result in fines, liens and legal action.

Where the By-Laws are vague or silent, the Architectural Control Committee provides guidelines to maintain the “Aesthetic Balance, with Consistency, Uniformity, Harmony and Compatibility” of our community.

This set of Guidelines has been developed over the years to help everyone understand what is acceptable and what is not acceptable. No Guideline should supersede or override the By-Laws

You must submit a Request Form to make any changes to any part of the exterior of your home or property.  Do not assume that if it's not explicitly stated in the Declaration of Covenants, Conditions and Restrictions of ACC Guidelines that there are no standards.

IMPORTANT:  The Architectural Control Committee must approve all improvements prior to work starting

Instructions

NOTE: The Architectural Control Committee meets the first Wednesday of every month, if they have any requests. Requests must be submitted by the last Wednesday of the previous month. Please PLAN AHEAD. Depending on the next meeting date your request may take several weeks before it is reviewed.

  1. Look through the Guidelines to see if your request has a specific Guideline
  2. If there is a Guideline, make sure your request complies with the Guideline
  3. Download the Architectural Control Committee (ACC) REQUEST FORM
  4. Read the instructions to assist you in completing the request form. Click here to view the instructions.
  5. Complete the Form
  6. If you are using a contractor, you will need to get a Certificate of Liability Insurance naming Eagle Lakes Estates Homeowners Association, Inc. as a Certificate Holder and attach it to the form.  (see example attached to the Architectural Control Committee (ACC) REQUEST FORM)
  7. Attach any diagrams, pictures, drawings, color samples needed to fully explain your project to the Architectural Control Committee. Note: Any missing information or vagueness could delay your approval.
  8. Mail or email your request along with all supporting materials to the Architectural Control Committee using the addresses at the top of the form.
  9. Once received the Architectural Control Committee will notify you of receiving the request and let you know when the next meeting is scheduled.
  10. After the meeting you will be notified in writing of an Approval, Denial or Request for More Information.

IMPORTANT:  Do not Begin any work until you have received written approval form the Architectural Control Committee.
